Terms of Service for Effici

1. Acceptance of Terms

By downloading, installing, or using the Effici mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and the operators of Effici (“we”, “us”, or “our”).

2. Description of Service

Effici is a productivity application that provides:

Pomodoro timer functionality for focus sessions
Session tracking and history
Project and tag management
Eye health reminders (20-20-20 rule)
Ambient audio for concentration
Cloud synchronization across devices
Data export capabilities

The App is provided in two versions:

Free Version: Full functionality with advertisements
Premium Version: Ad-free experience with additional features available via subscription plans

3. Account Registration

3.1 Eligibility

You must be at least 13 years old (or 16 in the EU) to create an account and use Effici.

By creating an account, you represent that:

You are of legal age to form a binding contract
All information you provide is accurate, current, and complete
You will maintain the accuracy of such information

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 One Account Per User

You may only create and maintain one account. Multiple accounts by the same individual are prohibited.

4. User Conduct

4.1 Acceptable Use

You agree to use Effici only for lawful purposes and in accordance with these Terms.

You agree NOT to:

❌ Use the App to violate any laws or regulations
❌ Impersonate another person or entity
❌ Attempt to gain unauthorized access to our systems
❌ Interfere with or disrupt the App’s functionality
❌ Upload malicious code or viruses
❌ Reverse engineer, decompile, or disassemble the App (except as permitted by law)
❌ Use automated systems (bots, scrapers) to access the App
❌ Sell, rent, or sublicense your access to the App
❌ Remove or modify any copyright or proprietary notices

4.2 Content Guidelines

While Effici allows you to create session descriptions, project names, and tags, you agree:

Not to include offensive, abusive, or illegal content
Not to include personal information of others without consent
Not to use the App to store or transmit malicious content

We reserve the right to remove content that violates these guidelines.

5. Intellectual Property Rights

5.1 Our Proprietary Rights

The App, including all content, features, functionality, and underlying code, is owned by us and protected by:

Copyright laws
Trademark laws
Other intellectual property laws

Our Rights Include:

The Effici name and logo
The user interface design
The App’s source code
All original graphics and content

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal device
Use the App for your personal, non-commercial productivity purposes

This license does not include the right to:

Modify, distribute, or create derivative works
Reverse engineer or attempt to extract source code
Use the App for commercial purposes (without written permission)

5.3 Your Content

You retain all rights to the productivity data you create in Effici (session descriptions, project names, tags). By using the App, you grant us a limited license to:

Store your data on our servers
Process your data to provide the service
Back up your data to prevent loss
Display your data to you across your devices

We do not claim ownership of your productivity data.

6. Subscriptions and Purchases

6.1 Pricing

If you purchase Effici Premium:

Prices are displayed in the App and may vary by region
Prices are subject to change with reasonable notice
Payment is processed through Google Play Store

6.2 Billing

Subscriptions auto-renew unless cancelled 24 hours before the renewal date
You will be charged through your Google Play account
Cancellations take effect at the end of the current billing period

6.3 Refunds

Refunds are subject to Google Play Store’s refund policy
We do not issue refunds directly (Google handles all transactions)
Contact Google Play support for refund requests

6.4 Free Trials (If Applicable)

Free trials may be offered for Premium features
You can cancel anytime during the trial without charge
If not cancelled, you will be charged when the trial ends

7. Advertisements (Free Version)

7.1 Ad Display

The free version of Effici displays advertisements powered by Google AdMob.

By using the free version, you agree that:

Ads may be displayed at various points in the App
Ad content is provided by third parties (not under our control)
Ad personalization is based on your advertising ID (you can opt out in device settings)

7.2 Third-Party Ad Content

We are not responsible for:

The content of third-party advertisements
Products or services advertised
Any issues arising from clicking on ads

Click on ads at your own risk.

7.3 Removing Ads

You can remove ads by:

Upgrading to Effici Premium
Opting out of personalized ads (device settings)

8. Data and Privacy

8.1 Privacy Policy

Your use of Effici is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Collection

By using the App, you consent to:

Collection of data as described in the Privacy Policy
Transfer of data to our servers (Supabase)
Use of data to provide and improve the service

8.3 Data Security

While we implement security measures to protect your data:

We cannot guarantee absolute security
You use the App at your own risk
You are responsible for backing up critical data

9. Cloud Synchronization

9.1 Sync Functionality

Effici uses cloud synchronization to keep your data consistent across devices.

How Sync Works:

Data is automatically synced when you have an internet connection
Changes made on one device appear on all your devices
Conflicts are resolved automatically (last write wins)

9.2 Sync Limitations

Sync requires an active internet connection
Large amounts of data may take time to sync
Sync may fail if your account is suspended or deleted

9.3 Data Conflicts

In case of sync conflicts:

Most recent changes typically take precedence
We are not liable for data loss due to sync conflicts
Recommendation: Ensure stable internet connection before making critical changes

10. Third-Party Services

10.1 Backend Services

Effici uses Supabase for backend infrastructure. By using Effici, you also agree to Supabase’s Terms of Service and Privacy Policy.

Effici also uses third-party services such as Google AdMob (advertising) and Firebase Crashlytics (crash reporting/diagnostics). Their terms and privacy practices may also apply where relevant.

10.2 External Links

The App may contain links to third-party websites or services. We are not responsible for:

Content on external websites
Privacy practices of third parties
Products or services offered by third parties

Use third-party services at your own risk.

11. Disclaimers and Limitations of Liability

11.1 “AS IS” Disclaimer

EFFICI IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability

WE DO NOT WARRANT THAT:

The App will be error-free or uninterrupted
Defects will be corrected
The App is free from viruses or harmful components
Your data will never be lost

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF YOU HAVEN’T PAID ANYTHING)

THIS INCLUDES LIABILITY FOR:

Data loss or corruption
Lost profits or revenue
Business interruption
Device damage

11.3 Force Majeure

We are not liable for failures or delays caused by:

Natural disasters
War, terrorism, or civil unrest
Government actions
Internet or telecommunications failures
Other events beyond our reasonable control

12. Indemnification

You agree to indemnify, defend, and hold harmless Effici and its developers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your breach of applicable laws

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

Going to Settings → Account → Delete Account
Uninstalling the App

Upon termination:

Your access to the App will end immediately
Your data will be deleted as described in our Privacy Policy

13.2 Termination by Us

We may suspend or terminate your account if:

You violate these Terms
You engage in fraudulent or illegal activity
Your account is inactive for an extended period
Required by law

We will attempt to notify you before termination (except for serious violations).

13.3 Effect of Termination

Upon termination:

Your license to use the App ends immediately
You must stop using the App and delete it from your devices
We may delete your data after a grace period
Sections of these Terms that should survive termination will survive (e.g., indemnification, disclaimers)

14. Modifications to the App and Terms

14.1 App Modifications

We reserve the right to:

Modify or discontinue features at any time
Perform maintenance and updates
Change how the App works

We will attempt to notify you of significant changes.

14.2 Terms Modifications

We may update these Terms from time to time. We will notify you by:

Updating the “Last Updated” date
Displaying an in-app notification
Sending an email (for material changes)

Your continued use after changes constitutes acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the App and delete your account.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict of law principles.

15.2 Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at effici@yasindu.space to attempt to resolve the dispute informally.

Arbitration (If Applicable): Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the Arbitration Act, No. 11 of 1995 (Sri Lanka).

Exception: Either party may seek injunctive relief in court to protect intellectual property rights.

15.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only, not as part of a class action, consolidated action, or representative action.

15.4 Jurisdiction

If arbitration does not apply, you agree to the exclusive jurisdiction of the courts of Sri Lanka.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Effici.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to a successor or affiliate.

16.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

16.6 Language

If these Terms are translated into other languages, the English version shall prevail in case of any conflict.

18. Acknowledgment

BY USING EFFICI, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

If you do not agree to these Terms, do not use the App.
